The death penalty in the case of L.A. NEWNHAM, G. FORD and
Fifteen years penal servitude for J.R. HADDOCK, R.J. HARDY, R.J. ROUTLEDGE.

After graduating from British Military College, the accused NEWNHAM served in various places, and was appointed Chief of Staff, British Army Headquarters, HONGKONG, in January 1941. HADDOCK served in the Customs at KOWLOON, but was called up about June 141, to serve aboard a submarine. FORD was in command of a company of infantry from 1940 onwards. GREY was an officer in the air "troops" from 1940 onwards, HARDY was a sergeant in the air "force", and ROUTLEDGE was a wireless operator. All were serving in the forces when the war broke out, and consequently became prisoners of war when the Japanese forces occupied the town. They were interned in the (?) Camp..
After the fall of HONGKONG, a British organization in China directed its main attentions to operations in HONGKONG. The organization at WAICHOW which acted on instructions from the organisation at SHIU KWAN (1.0. KUKONG) tried to enlist membersof the HONGKONG Goverment and to undertake active espionage operations against the Japanese. Its operations finally extended to the HONGKONG P.0.1. Camp.
About January 1943 through the spy liaison personnel of the British organization in China LUI KA YAN and another, the accused NEWNHAM introduced clandestine messages from the British organization in China to the P.0.7% in the camp through a truck driver named LEE LAM, and determined to collect information about the Japanese forces for transmission to the organisation. About the beginning of February, he requested and incited the accused HADDOCK to assist him HADDOCK, who knew quite well what was going on, nevertheless responded favourably and from that time on until about July of the same year received from the British Organization through the above LUI KA YAN and others some fifteem secret messages giving him instructions, brought by the above LEE LAM and two other truck-drivers. These he delivered to the accused NEWNHAM, who in turn on mumerous occasions about this period collected detailed information as to what was happening in the camp and drew up fourteen or fifteen reports embodying this information. These he entrusted to the accused HAIDOCK, who passed them on LEE LAM and two others for tranmission to the British organization.
About May 1943, the accused FORD and GHKY decided to get into touch with the British Organization in CHINA and to collect information concerning the Japanese Army for transmission to it. They requested and incited HARDY and ROUTLEDGE to assist them. Both of these men, with a full knowledge of what they ware doing, complied and from then on until July they received about six letters of instructions from the British organization through LUI KA YAN, secretly brought in by the above-mentioned truck drivers. These they handed over to FORD and GREY, who in turn on several occasions drew up reports embodying detailed information they had collected concerning the camp, which they passed on to HARDY and ROUTLEDGE for transmission to the British Organization by the truck drivers.
The act of espionage, assisting and inciting to espionage or assisting espionage in every case come under the heading of repeated and habitual offences. Apart from the above explanation, bringing out the habitual nature of the offences, there are:
